AN ORDINANCE To AMEND APPENDIX B – ZONING OF THE CODE OF GLOUCESTER COUNTY, VIRGINIA, BY AMENDING ARTICLE 2 – DEFINITIONS, SECTION 2-2 – DEFINITIONS; AMENDING ARTICLE 5 – DISTRICT REGULATIONS, SECTION 5-2 OFFICIAL SCHEDULE OF DISTRICT REGULATIONS ADOPTED; AND AMENDING ARTICLE 9 – SUPPLEMENTARY DISTRICT REGULATIONS BY ADDING A SECTION 9-26 - CHICKEN-KEEPING
WHEREAS, the Gloucester County Board of Supervisors requested the Gloucester County Planning Commission consider ideas for an amendment to the Gloucester County Code which would accommodate the keeping of chickens in the single-family detached residential (SF-1) zoning district of Gloucester County; and
WHEREAS, the Gloucester County Planning Commission and staff have considered the Board’s request, reviewed ordinances from other localities, and obtained technical advice from various sources on the keeping of chickens in urban and suburban environments; and
WHEREAS, the Gloucester County Planning Commission developed and reached consensus on a list of definitions and recommendations which would ensure that chicken-keeping could be reasonably accommodated in the SF-1 zoning district of the County; and
WHEREAS, the adoption of an ordinance that supports the keeping of chickens in single-family detached residential areas is consistent with several goals in Gloucester County’s Comprehensive Plan including ensuring that the wishes of the community are translated into appropriate courses of action, updating the County’s regulations and codes as growth and development patterns warrant, ensuring that the character of these residential areas will be preserved by preventing the intrusion of incompatible uses, and the preservation of rural character; and
WHEREAS, the Gloucester County Planning Commission reached consensus on a draft ordinance amendment and held a public hearing on February 5, 2015, voting unanimously, with all members present, to forward the ordinance amendment to the Gloucester County Board of Supervisors with a recommendation of approval; and
WHEREAS, the Gloucester County Board of Supervisors has held a duly advertised public hearing, and is of the opinion that public necessity, convenience, general welfare, and good zoning practice will be furthered by such an amendment.
NOW, THEREFORE BE IT ORDAINED AND ENACTED, by the Board of Supervisors of Gloucester County, Virginia, this ___ day of _____________, 2015, that the Gloucester County Code, Appendix B, Article 2 – Definitions, Section 2-2 – Definitions; Article 5 – District Regulations, Section 5-2 – Official Schedule of District Regulations Adopted; and Article 9 - Supplementary District Regulations, be amended as follows:
APPENDIX B – ZONING
Add the following definitions to Appendix B – Zoning – Article 2 – Section 2-2 Definitions:
Capon: A neutered male chicken.
Domestic chicken: A chicken of the species Gallus gallus domesticus kept for the owner’s personal enjoyment and/or source of meat and/or eggs.
Poultry: All domestic fowl and game birds raised in captivity.
Chicken-keeping: The keeping of domestic chickens subject to the conditions specified in Section 9-26.
Amend Appendix B – Zoning – Article 5 – Section 5-2 OFFICIAL SCHEDULE OF DISTRICT REGULATIONS ADOPTED for Zoning District SF-1 to include Chicken-keeping as follows: [See attached table]
Amend Appendix B – Zoning – Article 9 - SUPPLEMENTARY DISTRICT REGULATIONS - Section 9-26. Chicken-keeping is hereby added.
Sec. 9-26. Chicken-keeping.
The following requirements and limitations shall apply to Chicken-keeping:
The keeping of up to four (4) female, domestic chickens shall be permitted under this section on any property containing an occupied single-family dwelling, or on an adjacent property with the same zoning and under the same ownership.
On eligible lots greater than 10,000 square feet but less than two (2) acres in area, a maximum of twelve (12) domestic chickens may be kept – provided there is a minimum total lot area of 2,500 square feet per chicken kept. Eligible lots over two (2) acres in area shall not be subject to the twelve (12) domestic chicken maximum.
Domestic chickens shall be kept contained within a fenced or enclosed area.
Chicken coops shall observe the same setbacks as the principal structure, and shall not occupy any required front yard.
Provisions shall be made for the collection, storage, and disposal of chicken waste (manure) so as to not to create a nuisance or health hazard.
All chicken feed and other products for consumption by domestic chickens shall be kept so as not to attract rodents, insects, or predators.
Outdoor slaughtering of domestic chickens is prohibited.
The keeping of roosters, capons, or crowing hens is prohibited.
